ASUU president denies calling state universities quacks institutions

Soohemba Aker, a university student, has asked the Federal High Court in Abuja to issue a directive suspending the operations of the Revenue Mobilisation, Allocation and Fiscal Commission (RMAFC) pending the outcome of the ASUU strike.

The Benue State University final-year law student also sought the same order suspending the operation of the Federal Account Allocation Committee (FAAC).

The Federal Government, the Academic Staff Union of Universities (ASUU), the Senate President, the Speaker of the House of Representatives, the Attorney-General of the Federation (AGF), and the Minister of Justice are among the respondents.

Others are Attorney Generals of the 36 states, Vice Chancellor of the University of Abuja, Abia Governor, RMAFC, FAAC, Umar Faruk (President, National Association of Nigerian Students (NANS).

The student, in a fundamental rights enforcement suit marked: FHC/ABJ/CS/1684/2022 and filed by her lawyer, Chukwuma-Machukwu Ume, SAN, said she is affected by the ongoing industrial action.

Aker filed the action for herself on behalf of all students of public tertiary institutions currently affected by the nationwide ASUU strike, NAN reports.

The suit relies on Sections 46(1), (2) and (3) of the 1999 Constitution and Article 17(1) of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act Chapter A9 (Charter 10 LFN 1990) No. 2 of 1983.

Aker prayed the court for an order stopping the payment of salaries, allowances and other benefits of all political office holders at the Presidency and federal lawmakers.

She urged the court to stop salaries and allowances of ministers, permanent secretaries, heads of parastatals and extra-ministerial bodies, VCs of striking universities, lawmakers and ASUU members.

Aker’s affidavit averred that the strike continues to affect her adversely as her plans of graduating this academic year 2022 and proceed to the Nigerian Law School had been thwarted.

The citizen lamented that her tuition fees paid for the academic year will go in vain as the academic year is almost lost if nothing is done.

Aker added that her dream of becoming a law graduate and a lawyer was at the verge of collapsing as her sponsor declared this year was the last she would be funded.

FG, ASUU to reconvene on Feb. 28

The matter is yet to be assigned to a judge. ASUU embarked on strike on February 14, 2022. The impasse is yet to be resolved despite a series of meetings.

FG ASUU out of court settlement move fails

The federal government and the Academic Staff Union of Universities (ASUU) are yet to come to a consensus on addressing the issues that led to the union’s strike.

ASUU has been on strike since February 14 to press home the demand for improved funding for universities, and a review of salaries for lecturers, among other issues.

After several meetings between ASUU and the federal government ended in stalemate, the federal government went to the national industrial court to challenge the strike.

The court of appeal sitting in Abuja, on Wednesday, had asked the parties to explore the option of an out-of-court settlement.

Strike: Dapo Abiodun begs Nigerian government, ASUU to resolve impasse

Georgewill Abraham, the judge, had suggested that the federal government and ASUU take 24 hours to dialogue and come up with a resolution that would make Nigerians happy.

But at the hearing on Thursday, James Igwe, counsel to the federal government, and Femi Falana, counsel to ASUU, told the court of appeal that a resolution had not been reached.

Hamma Barka, the presiding judge, thereafter, stepped down the matter for an hour to enable ASUU file a reply to the counter affidavit deposed to by the federal government in opposition to the hearing of the union’s appeal.

At the resumption of the hearing, Falana said they had begun consultations which would continue at the end of the day’s proceedings.

He also asked that ASUU’s application challenging the ruling of the industrial court be heard by the appeal court.

Both parties agreed that the court should hear the application, as there was no amicable resolution reached as advised.

The next hearing is scheduled for Friday.
