Tennis star Kyrgios faces two-year jail over assault charge

Nick Kyrgios

Nick Kyrgios’ lawyers will apply for the tennis star’s assault charge to be dismissed on mental health grounds, an Australian court was told on Tuesday. Kyrgios could face two years in prison should he be handed a maximum sentence.

The 27-year-old was charged in July of this year concerning the alleged assault of a former partner in January 2021.

Kyrgios, who has enjoyed a fine season in 2022, reaching the final of Wimbledon and the last eight at the U.S. Open, was not present for a hearing in Canberra on Tuesday.

He presently features in the Japan Open.

Michael Kukulies-Smith, representing Kyrgios, asked for the case to be adjourned so forensic mental health reports could be prepared.

The magistrate Glenn Theakston adjourned the case until February 3, 2023.

It is then expected that Kyrgios’ legal representatives will apply to dismiss the case.

Kukulies-Smith had stated he was making the application having reviewed Kyrgios’ “medical history since 2015, including public disclosures of his mental health struggles.”

Australian law dictates that magistrates have the power to dismiss a charge.

This is if they believe an accused person is mentally impaired and that dealing with a charge in such a manner would benefit both the defendant and the community.

Stampede: Watchdog faults police’s tear-gassing Indonesia football fans

Stampede: Watchdog faults police’s tear-gassing Indonesia football fans

An internal oversight official on Tuesday said Indonesian police wrongly used tear gas inside a soccer stadium to disperse rioting fans.

However, the country’s soccer federation banned two club officials over the chaos that killed at least 125 people.

Over a hundred spectators were crushed in one of the world’s worst stadium disasters as they tried to flee the overpacked stadium in Malang, East Java.

This happened after police fired tear gas to disperse agitated fans of the losing home team, Arema FC, who had poured onto the pitch.

Police said 125 died, while the Malang city health department put the death toll at 131.

Indonesia’s soccer federation (PSSI) said the club’s security officer and the head of its organising committee would be banned from the sport for life and fined the club 250 million rupiah ($16,398).

“There were many weaknesses from the organising committee,” Erwin Tobing, head of the association’s disciplinary committee, said.

According to PSSI, Officials from the world football governing body FIFA and the Asian Football Confederation would visit the country without specifying details.

There were no orders to use tear gas on the crowd, said Albertus Wahyurudhanto, an official with the National Police Commission, an oversight body that reports to the country’s president.

“Tear gas was supposed to be (fired) outside. There are suspicions of a violation of instructions,” he told reporters, adding “the commission will share its findings with a fact-finding team set up by the government.”

Fans of the winning team, Persebaya Surabaya, had been banned from attending the game for fear of clashes, so most of the victims, which included 33 children, were the home club Arema’s fans.

While the stadium in Malang has several exit gates, spectators told Reuters some of these were locked during Saturday’s match, causing bottlenecks as stampeding fans tried to flee.

Medics said some victims died of suffocation, while others suffered head injuries.

Haura, a 20-year-old spectator and university student, said the incident was “so terrifying. I felt suffocated, and my eyes hurt.”

Mr Wahyurudhanto said it was unclear why some exits were locked.

Hooliganism, heavy-handed policing and event mismanagement are not unusual in Indonesia, where football is hugely popular and sparks fierce rivalries between fans of various clubs.

Football’s world governing body, FIFA, bans using “crowd control gas” and weapons at matches.

Choirul Anam on Indonesia’s human rights body, Komnas HAM, said if tear gas had not been fired “maybe there wouldn’t have been chaos.”

33 children killed in Indonesian football stampede: Official

At least 33 children were among those killed in a stampede at an Indonesian football stadium at the weekend, an official confirmed on Tuesday.

The youngest identified out of the 125 people killed was a toddler about three or four years old, said an official, a deputy at the Ministry for Women Empowerment and Child Protection.

“This still can change because we have not received all the information from families of the victims,’’ the official told dpa.

The national police earlier on Monday sacked the Malang district police chief, Ferli Hidayat, as part of an investigation into the stampede on Saturday at the Kanjuruhan Stadium.

This is among the world’s worst sports disasters.

Nine other commanding officers were suspended and questioned on suspicion of ordering security personnel to fire tear gas inside the stadium.

However, chaos erupted after thousands of fans invaded the pitch as hosts Arema FC lost 3-2 to rival East Java club Persebaya Surabaya.

Police fired tear gas to quell the pitch invaders, sending spectators scrambling to the exit gates.

The deadly stampede prompted Indonesian President Joko Widodo to order the suspension of the top-flight Liga 1 competition pending a review.

The police said most of the victims died of a lack of oxygen and from being trampled during the stampede.

Officials also said more than 300 people were seriously injured.

The use of tear gas raised questions about whether security personnel had followed proper procedures in dealing with a crowd inside a stadium.
